DESCRIPTION FOR BUYING A PLOT

  1. Maharashtra is one of the best destinations for setting up an industry due to the business-friendly policies of the Government of Maharashtra, along with various other favorable factors. Maharashtra Industrial Development Corporation (MIDC) land is recommended for setting up a factory or IT Park due to ease of business and simplified MIDC rules, allowing land acquisition and production under a 95-year lease based on specific terms and conditions outlined in the Lease Deed.

  2.  For projects that do not require large land areas and fall under the medium or small-scale category, setting up an industry on MIDC land is ideal due to its infrastructure, availability of water, power, labor, CETP, and good connectivity. MIDC also offers various benefits under the Maharashtra Industrial Policy. For industrial units classified under the Red category (small, medium, or large), MIDC land is highly recommended as it simplifies the process of obtaining necessary permits and licenses. Although MIDC land may be relatively expensive, its overall advantages, including infrastructure and facilities, outweigh the benefits of freehold land for industrial setup.

  3. MIDC allots industrial land through a direct online application process. In cases where plot availability is limited compared to demand, MIDC may conduct an auction. Commercial and residential plots in MIDC are typically allotted through auctions.

  4. When submitting an application for an industrial plot in MIDC, the following documents must be included:

    • Request Letter to MIDC on company letterhead
    • Online Application
    • White Application Form, duly filled
    • Detailed Project Report
    • Copy of MOA (for Pvt. Ltd.) / Registered Partnership Deed (for Partnership Firms)
    • Shareholding Certificate (for Pvt. Ltd.)
    • Board Resolution (for Pvt. Ltd.)
    • Block Plan outlining the proposed utilization of the plot
    • Demand Draft for processing fees
  5. After reviewing the submitted proposal, MIDC issues a letter to the applicant to present the case before the Land Allotment Committee (LAC).

  6. The Land Allotment Committee evaluates the project’s viability and decides on the allotment of the plot.

  7. If the LAC approves the allotment, MIDC issues an Offer Letter, requiring the applicant to pay 25% of the Earnest Money Deposit (EMD) within 15 days.

  8. Upon EMD payment, MIDC issues an Allotment Letter, specifying the plot number, and instructs the applicant to pay the remaining 75% of the premium within 30 days.

  9. Road width charges apply to plots up to 10 acres. A 50% concession is available for plots between 10 to 25 acres, while plots above 25 acres or investments exceeding ₹100 crores are exempt from these charges.

  10. After completing the balance payment, MIDC grants possession of the plot, and an Agreement to Lease is executed between MIDC and the allottee.

  11. The entire MIDC plot allotment process typically takes 3-4 months. Once possession is obtained and the Agreement to Lease is signed, the entrepreneur must secure various consents and licenses to establish the industry. Essential permits include MSME registration from DIC, MPCB Consent to Establish, and Provisional Fire NOC from MIDC Fire Department before submitting plans to the Special Planning Authority (SPA).

  12. If the MIDC plot will store hazardous, explosive, or inflammable materials, the allottee must obtain permission from the Maharashtra Pollution Control Board (MPCB) based on the relevant category (Orange, Red, White).

  13. The next step involves obtaining plan approvals from the MIDC Planning Authority and initiating land development. MIDC provides temporary water connections for construction, and MSEB offers temporary electricity connections. Upon completion of construction, the allottee must obtain a Building Completion Certificate (BCC), Drainage Completion Certificate, Tree Plantation Certificate, and Occupancy Certificate (OC) from the SPA before installing plant and machinery.

  14. Post-construction, the entrepreneur must obtain MSME Registration, MPCB Consent to Operate, and a Factory License. A permanent water connection requires executing a Water Supply Agreement with MIDC, and electricity must be secured from MSEB. Additional permits or licenses may be required, depending on the specific industry.
